ADI terms and conditions
Fast Track Lessons – Instructor Partnership Terms & Conditions (ADIs and PDIs)
Effective date: 01 January 2025
Last updated: 01 March 2026
Purpose. These Terms & Conditions govern the relationship between Fast Track Lessons (“FTL”, “we”, “us”, “our”) and Approved Driving Instructors (ADIs) participating in our instructor partnership program. By applying, registering, accepting an allocation, or delivering any course sourced from FTL, you agree to these terms.
1. Introduction & Values
These terms set out expectations, standards, and legal obligations for ADIs partnering with FTL. We aim to:
- Maintain high-quality instruction aligned with DVSA guidance and FTL standards.
- Ensure compliance with applicable laws and regulations.
- Promote a professional, respectful, safe, and inclusive environment for instructors and customers.
These terms reflect FTL’s ethos and form part of your contractual obligations.
2. Acceptance of Terms
By signing up to FTL or accepting an allocation, you confirm your agreement to these Terms & Conditions. We recommend reviewing them periodically; the most recent version applies to any allocation or delivery you accept (see Clause 30: Changes to Terms).
3. Equal Opportunity & Inclusion
FTL is committed to equal opportunities. We do not reject applications or tolerate discrimination based on any protected characteristic under the Equality Act 2010.
- Voluntary disclosure: You may share information (e.g., languages spoken) to facilitate customer matching. This is optional and handled respectfully.
- Zero tolerance for prejudice: FTL does not accept prejudiced requests from customers or instructors.
4. Eligibility & Professional Status
FTL works with ADIs listed on the DVSA register and PDIs for fast‑track delivery.
By participating, you warrant:
- You are an ADI or PDI in good standing (and will notify FTL immediately of any suspension/invalidation).
- You hold valid motor insurance for instruction use and any applicable public liability cover.
- Your vehicle is safe, roadworthy, clean, and suitable for DVSA testing.
5. Independent Contractor Relationship
You are engaged as an independent contractor, not an employee or agent of FTL. You are responsible for your tax, NI, and regulatory compliance. Nothing in these terms creates a partnership, joint venture, or employment relationship.
6. Personal Information & Privacy
FTL collects necessary onboarding and operational data (e.g., name, address, ADI number, contact details; (MOT/insurance expiry and language preferences) to allocate courses and support operations.
- Data Use: We process personal data under UK GDPR/Data Protection Act 2018.
- Data Sharing: We share data only as necessary (e.g., with the customer, payment processors, and systems providers) and subject to appropriate safeguards.
- Your Privacy Obligations: When you receive customer data from FTL, you act as an independent controller for that data, must comply with UK GDPR, keep data secure, use it only for course delivery, and delete/securely store it when no longer needed.
- See our Privacy Notice for full details (available on our website).
7. Identification & Welcome Materials
FTL may issue an ID badge and a welcome pack to support customer reassurance and brand consistency. Use of FTL brand assets must follow Clause 21 (Brand Use).
8. Vehicle Standards (Smoke‑Free & Cleanliness)
Your car is a workplace and must comply with all applicable smoke‑free and safety regulations.
- Smoking: Smoking in a work vehicle is unlawful; do not smoke in your instruction vehicle at any time.
- Vaping: While not prohibited by law, vaping is not permitted during lessons or within the vehicle between lessons to avoid discomfort and safety risks.
- DVSA Refusal: If DVSA refuses your car for test due to its condition or compliance, you are liable for the replacement test fee (prevailing DVSA rate).
- Cleanliness: Maintain a clean, hygienic interior. Customers may refuse lessons if the car is unfit.
9. How FTL Offers Courses
FTL offers courses via SMS, email, and phone. During high demand, we may consult the DVSA register to support customer waiting times. No minimum volumes are guaranteed.
10. Claiming & Allocation
You may claim courses via the website or by responding to FTL communications.
- First-come, first-served, unless an area has an assigned priority ADI or PDI (see Clause 11).
- Claiming a course without intent to deliver is prohibited.
11. Priority Allocations & Local Listings
FTL may offer priority allocations in certain areas linked to local visibility (e.g., Google Business listings near your home postcode). Listing participation is optional. Priority does not override quality, compliance, or customer needs.
12. Customer Relationship
Learners allocated by FTL remain FTL customers until conclusion of the course. Do not represent otherwise. All communications should reflect that you are delivering on behalf of FTL.
13. Contacting the Customer
Contact the customer within 48 hours of allocation to introduce yourself (on behalf of FTL) and propose a schedule.
14. Scheduling & Start Date
Set a start date at least 7 days out so FTL can collect balances and schedule your payment. Starting earlier risks unpaid sessions if customer fails to settle balances.
15. Course Types
- Fast‑Track: Typically 2–6 hours per day over consecutive days.
- Semi‑Fast‑Track: Multiple sessions per week (with rest days), longer overall duration.
- Bespoke: Tailored schedule agreed with the customer for specific needs.
Use the first hour to assess ability and confirm hours align with the customer’s goal.
16. Test Buffer
Create a full course schedule and retain at least 2 hours for the driving test and pre‑test warm‑up (DVSA scheduling may vary).
17. Door‑to‑Door Service
Provide pickup/drop‑off at the customer’s booked address unless mutually agreed otherwise.
18. Fees & Rates
FTL sets course rates by area and demand. Once you accept a fee at allocation, that is the fee. Review location and requirements before acceptance. No post‑acceptance fee changes.
19. Payment
FTL pays by bank transfer 48 hours before the course start date, subject to balances being collected and the start date being at least 7 days from allocation.
- You must not request additional fees from the customer outside the agreed structure (see Clause 20).
20. No Additional Customer Charges
You may not charge customers any extra fees (e.g., “test day insurance,” “car hire,” “return‑time”).
- Exception: Only where FTL pre‑approves in writing and clearly communicates to the customer in advance (e.g., optional add‑ons) may additional charges apply.
- Breach may result in repayment of amounts received (used and unused hours) and removal from FTL’s approved list.
21. Brand Use & Marketing
You may use FTL brand assets only as provided and in accordance with our guidelines. Do not create or use modified logos or listings implying you are employed by FTL. Any local listings arranged by FTL must be managed per FTL instructions.
22. Sub‑Contracting
Sub‑contracting FTL courses is prohibited unless FTL pre‑approves in writing the named ADI (for safeguarding and quality assurance). Unapproved delegation is grounds for removal and fee recovery.
23. Delivering a Fast‑Track Course
If you accept a Fast‑Track course, you must deliver it over consecutive days unless the customer requests or FTL approves a variation for safety/wellbeing or operational reasons.
- Failure to meet Fast‑Track requirements without valid justification may result in reallocation and recovery of fees for undelivered hours.
24. Scheduled Hours & Breaks
All scheduled hours must be fulfilled. Plan appropriate breaks (e.g., at least 15 minutes every 2 hours) without reducing paid instruction time.
- Customer ad‑hoc stops may be deducted from their hours.
- Instructor stops must not reduce course hours.
25. Rescheduling & Proof
Do not rearrange hours without customer agreement and informing FTL.
- Unavoidable issues (illness, breakdown, emergencies) require reasonable proof if requested.
- Without sufficient proof, FTL may support customer refunds/chargebacks and recover paid amounts for undelivered hours.
26. Records: Progress Report & Time Card
The instructor and pupil will agree together on how progress updates are recorded. This may include using the FTL’s progress report template or recommended apps to document lesson coverage and hours delivered, with photos provided to FTL upon completion (see Clause 29).
27. Test Readiness & Vehicle Use
You are not obliged to provide your car for test if, in your professional judgment, the customer is not at a safe test standard or the vehicle would be used unsafely. Use the time for instruction if the car is not provided.
- Where reasonable and safe, customers may attempt the test; DVSA will provide feedback in the debrief.
28. Cancellations
Pupil short‑notice cancellations (unless required by law or DVSA reschedules):
- Fast‑Track with test booked: Cancelled hours are lost; no rearrangement.
- Semi‑Fast‑Track & Non‑Fast‑Track: Minimum 48 hours’ notice required or hours/fees may be forfeited.
ADI or PDI short‑notice cancellations:
- Avoid short‑notice cancellations. If your cancellation causes schedule failure, complaints, reallocation, or refunds, you are liable for corresponding amounts for undelivered hours.
- Force majeure: Serious events (e.g., illness, accident, emergency, DVSA test movement) will be handled reasonably; provide proof and work with FTL to reschedule.
29. Course Completion
At completion, report the outcome and provide:
- A pass photo (where applicable).
- Optional: If the customer leaves a Trustpilot review, FTL may issue a £10 bonus by bank transfer (subject to FTL promo availability).
Professional Conduct: Maintain professional standards at all times. Unprofessional conduct may result in removal and recovery of fees for undelivered hours.
30. Changes to Terms
By accepting any FTL course, you agree to the current version of these Instructor Terms. FTL may update these terms; material changes will be posted on our website with updated “Last updated” date. Continuing to accept allocations constitutes acceptance of changes.
31. Course Expiry & Communication
You have six months to complete allocated courses. If the customer is unavailable for reasons beyond your control, you won’t be expected to return fees provided FTL can verify that communication ceased from the customer.
- If the customer shows evidence of attempts to reach you, this supersedes expiry and you must continue. Failure to do so may result in reallocation and recovery of spent/unspent fees and test fees if refunds occur.
32. Refunds & Repayments to FTL
Refunds or repayments due to FTL must be made within 7 days of first request.
- Failure may lead to collections/legal action and (where appropriate) notice to relevant authorities.
- Refunds must be via bank transfer or cash deposit.
- Where hours remain unused, repay the unused balance to FTL at the same hourly rate paid; no admin fees may be deducted.
33. Fair Delivery & Dilution
If a customer purchased Fast‑Track and you accepted it, do not dilute into spread‑out lessons unless agreed with the customer and FTL.
- Unsupported dilution may entitle the customer to a refund; FTL may recover related amounts for undelivered hours.
34. Liability, Insurance & Indemnity
- You must maintain valid motor insurance for instruction use and any reasonable public liability insurance.
- You are responsible for your acts/omissions in delivering instruction and for compliance with DVSA requirements.
- FTL is not liable for your independent acts/omissions.
- You agree to indemnify FTL for losses arising from your breach of these terms, unlawful conduct, or misuse of FTL brand/assets—except to the extent caused or contributed to by FTL.
35. Safeguarding & Conduct
- Maintain a calm, professional demeanor; never react angrily to learner mistakes.
- Do not discuss personal issues during lessons.
- Report safeguarding concerns or incidents to FTL promptly and, where applicable, to relevant authorities.
- Where legally required or agreed, provide DBS information consistent with safeguarding expectations.
36. Compliance & Audit
FTL may verify ADI registration, insurance status, and adherence to these terms. You agree to cooperate with reasonable compliance checks. You must follow the Highway Code and DVSA guidance at all times.
37. Disputes & Complaints
Raise issues promptly with FTL. We’ll work to resolve customer concerns fairly. FTL’s customer terms protect both ADIs and FTL and are published on our website. You must not ask FTL customers to sign your own terms; customers are already contracted under FTL’s terms.
38. Termination & Suspension
FTL may suspend or terminate your participation for material breach, non‑delivery, unprofessional conduct, safety concerns, or regulatory issues. FTL may recover amounts for undelivered hours and fees as appropriate.
39. Governing Law & Jurisdiction
These terms are governed by the laws of England & Wales. Courts of England & Wales have exclusive jurisdiction.
